Charters Towers Regional Council (Making of Local Laws) NOTICE (No. 2) 2021

1.            This notice is published in accordance with s29B (4) of the Local Government Act 2019 and may be cited as the Charters Towers Regional Council (Making of Local Laws) Website Notice (No. 2) 2021.

Making of Local Laws

2.            Charters Towers Regional Council (“the Council”) has, by resolution dated 21 July 2021, made Amending Subordinate Local Law No. 1 (Miscellaneous Subordinate Local Laws) 2021, Subordinate Local Law No. 1 (Administration) 2021 and Repealing Local Law No. 1 (Miscellaneous Local Laws) 2021.

Subordinate Local Laws Amended

4.            Amending Subordinate Local Law No. 1 (Miscellaneous Subordinate Local Laws) 2021 amends: -

  1. Subordinate Local Law No. 2 (Animal Management) 2011;
  2. Subordinate Local Law No. 3 (Community and Environmental Management) 2011;
  3. Subordinate Local Law No. 4 (Local Government Controlled Areas, Facilities and Roads) 2011; and
  4. Subordinate Local Law No. 5 (Parking) 2011.

Purpose

5.            The purpose of this local law is to amend –

               (a)          Subordinate Local Law No. 2 (Animal Management) 2011 to:

  1. amend the form of identification required for dogs in certain circumstances;
  2. restrict the type of animal that may be disposed of without an auction or tender;
  3. amend the requirements and standards for keeping animals;
  4. specify public locations where animals are prohibited;
  5. designate dog off-leash areas;
  6. amend the criteria for declared dangerous animal;
  7. amend the conditions for the sale of animals;
  8. amend the definitions in section 15; and
  9. correct formatting and renumbering.

(b)          Subordinate Local Law No. 3 (Community and Environmental Management) 2011 to: 

  1. amend the meaning of community safety hazards;
  2. amend the definitions in schedule 7; and
  3. correct formatting and renumbering.

(c)           Subordinate Local Law No. 4 (Local Government Controlled Areas, Facilities and Roads) 2011 to:

  1. amend what are prohibited and restricted activities;
  2. amend the conditions in relation to motor vehicle access areas;
  3. change the opening hours for some local government controlled areas;
  4. remove the permanent closure of local government controlled areas;
  5. better identify some local government controlled areas;
  6. amend the definitions in schedule 7; and
  7. correct formatting and renumbering.

(d)          Subordinate Local Law No. 5 (Parking) 2011 to:

  1. declare the entire local government area a traffic area;
  2. declare off-street regulated parking areas; 
  3. better define who may hold parking permits issued by Council;
  4. amend the identification label requirements of commercial vehicles;
  5. insert maps of traffic and off-street regulated parking areas;
  6. amend the definitions in schedule 4; and
  7. correct formatting and renumbering.

Subordinate Local Law No. 1 (Administration) 2021

6.            Subordinate Local Law No. 1 (Administration 2021) repeals and consolidates:

  1. Subordinate Local Law No. 1.1 (Alteration or Improvement to Local Government Controlled Areas and Roads) 2011;
  2. Subordinate Local Law No. 1.2 (Commercial Use of Local Government Controlled Areas and Roads) 2011;
  3. Subordinate Local Law No. 1.3 (Establishment or Occupation of a Temporary Home) 2011;
  4. Subordinate Local Law No. 1.4 (Installation of Advertising Devices) 2011;
  5. Subordinate Local Law No. 1.5 (Keeping of Animals) 2011;
  6. Subordinate Local Law No. 1.6 (Operation of Camping Grounds) 2011;
  7. Subordinate Local Law No. 1.7 (Operation of Cane Railways) 2011;
  8. Subordinate Local Law No. 1.8 (Operation of Caravan Parks) 2011;
  9. Subordinate Local Law No. 1.9 (Operation of Cemeteries) 2011;
  10. Subordinate Local Law No. 1.10 (Operation of Public Swimming Pools) 2011;
  11. Subordinate Local Law No. 1.11 (Operation of Shared Facility Accommodation) 2011;
  12. Subordinate Local Law No. 1.12 (Operation of Temporary Entertainment Events) 2011;
  13. Subordinate Local Law No. 1.12 (Operation of Temporary Entertainment Events) 2011;
  14. Subordinate Local Law No. 1.13 (Undertaking Regulated Activities regarding Human Remains) 2011;
  15. Subordinate Local Law No. 1.14 (Undertaking Regulated Activities on Local Government Controlled Areas and Roads) 2011;
  16. Subordinate Local Law No. 1.15 (Carrying Out Works on a Road or Interfering with a Road or its Operation) 2011;
  17. Subordinate Local Law No. 1.18 (Bringing or Driving a Motor Vehicle onto a Local Government Controlled Area) 2011;
  18. Subordinate Local Law No. 1.19 (Parking Contrary to an Indication on an Official Traffic Sign Regulating Parking by Time or Payment of a Fee) 2011; and
  19. Local Law Policy No.P24 (Gates and Grids).

Purpose

7.            The purpose of this local law is to repeal and consolidate the above subordinate local laws into a local law and to make amendments to account for current laws and policy when granting approvals for certain activities.

Repealing Local Law No. 1 (Miscellaneous Local Laws) 2021

8.            Repealing Local Law No. 1 (Miscellaneous Local Laws) 2021 repeals:

               (a)          Local Law No. 1 (Meetings) 2008; and

               (b)          Local Law (Gates and Grids) 1995.

Purpose

9.            The purpose of this local law is to repeal the above local laws.
